The web shop is the intellectual property of PZTrs and can only be used with the express permission of the copyright holder and the holder of trademark and/or design rights. PZTrs enable the use of the services and content of the web store  https://vinarija-trs.com/  as regulated by these Terms of Business.

These Terms of Business (Pre-Contractual Notices) are part of the Seller’s obligation in accordance with the provisions of the Consumer Protection Act, with the aim that the Buyer, before entering into a distance contract, is informed in a clear and comprehensible manner about a series of circumstances essential for the conclusion, execution, termination of the contract, and all in in accordance with the legal regulations.

The term “Customer” refers to a natural person who orders and pays for any product outside of any activity through the services of the e-wine store; that is, web stores present on the Seller’s website.

By selling through the web store  https://vinarija-trs.com/, the seller    acts on his own behalf.


The conditions of purchase (Pre-contractual notices) form part of the contract concluded at a distance together with the specifications and price(s) of the purchased product(s), and before confirming the order for the purchase of an individual product, the Buyer will be asked to accept/declare that he/she is familiar with/agree with the conditions, and after confirmation of the order (conclusion of the contract) the same shall be delivered to the Customer as the content of an e-mail message confirming that the contract has been concluded. The seller reserves the right to change the terms and conditions at any time, with the said changes entering into force after publication on this web store.

When the Customer confirms and completes the order, the contract is concluded. After confirming the order, i.e. accepting the terms of purchase, the seller immediately informs the customer that the contract has been concluded by e-mail.

The contract is concluded and valid only if the buyer is an adult and has full business capacity. The sale of alcohol is prohibited to persons under the age of 18. The Customer is fully responsible for the truthfulness and completeness of the entered data.


Access to the web store  https://vinarija-trs.com/  may sometimes be unavailable due to works, maintenance or the introduction of new content and in cases of unforeseen circumstances beyond the control of the Seller, which the Seller will try to remedy as soon as possible.

Providing your personal data is voluntary. We do not process more personal data than is really necessary to respond to your inquiry.

PZ Trs stores personal data of registered Customers of the website  https://vinarija-trs.com/  for the period while the purpose of the processing is achieved, which is the period until the moment when the registration is active and six months after the end of the Customer’s registration, during which period any complaints from the previous period should be resolved.

Deletion of personal data (right to be forgotten)

The customer and user have the right to request deletion of personal data (right to be forgotten) at any time. The customer can do this by sending a request to  the e-mail info@vinarija-trs.com  and the data will be deleted without delay.

METHODS OF PAYMENT
Terms of payment
You can pay for the ordered goods by general money order, debit/credit card or cash on delivery.

PAYMENT BY GENERAL MONEY ORDER OR INTERNET BANKING
The customer is obliged to make the payment by general money order or internet banking within 24 hours from the moment of the order, and we will ship it after the bank executes the order. When calling the number, it is necessary to state the order number, and the payment is made to the IBAN HR opened at the bank.

PAYMENT BY VIRMAN (COMPANY)
After placing the order, within 24 hours we will send you an offer via the email you specified when placing the order. You pay for the ordered goods according to the offer within 24 hours, and upon receipt of the payment the ordered goods will be sent to your address.

PAYMENT BY DEBIT/CREDIT CARDS – Visa, MasterCard®, Maestro®.

The confidentiality of your data is protected and ensured by the use of SSL encryption. Online payment pages are secured using the Secure Socket Layer (SSL) protocol with 128-bit data encryption. SSL encryption is the process of encrypting data to prevent unauthorized access during its transmission.
This enables safe transfer of information and prevents unauthorized access to data during communication between the user’s computer and the WebPay service, and vice versa.
The WebPay service and financial institutions exchange data using a virtual private network (VPN), which is protected against unauthorized access.
Monri Payment Gateway is certified according to PCI DSS Level 1 security standard prescribed by Visa and Mastercard rules.
The merchant does not store debit/credit card numbers and the numbers are not accessible to unauthorized persons.

 

DELIVERY TERMS
Delivery price:
For orders up to 100.00 EU, the delivery price is 10.00 EU, regardless of the weight of the package.

For orders over 100.00 EU, delivery is FREE.

Delivery conditions

Delivery is made via the DPD courier service. Delivery is possible to the entire Republic of Croatia, Germany, Slovenia and Poland. Delivery time is 5-7 working days.

Payment methods

The prices on the webshop are valid only for online orders. The currency is the euro (EU). You can pay for the ordered goods in two ways (the choice is made in the third step of sending the order):
by bank transfer – immediately after creating the order with this payment method, you will receive a proforma invoice by e-mail. We pack and send the goods immediately upon receipt of payment. To speed up the delivery process, send us a payment confirmation by e-mail.
debit/credit cards – we pack and send the goods immediately after the successful transaction. The confidentiality of your data is protected and ensured by the use of SSL encryption.

 

Liability for material defects/claims

The seller is responsible for material defects of the products he sells on his website in accordance with the positive regulations of the Republic of Croatia, especially the Law on Obligations.

The ordered products are packed in such a way that they are not damaged by normal handling during transport or delivery.

In the event that the shipment is damaged during transport, and these damages are visible when the shipment is picked up, we suggest that the Buyer does not pick up the shipment. We ask customers to contact us so that we can check the status of the shipment as soon as possible and send a new one.

When receiving the goods, checking the correctness of the order depends on the buyer, and the buyer is obliged to compare the received items with the invoice, if something is missing, he is obliged to send a written complaint/complaint immediately, as subsequent complaints will not be accepted.

In the case of a visible lack of product when taking over the shipment, the Buyer is not obliged to take over the delivered product, can refuse receipt, and does not bear the costs of delivering such a product.

It is considered that the products that were duly received by the Customer had no visible defect. The customer has the right to complain in relation to material defects in the deadlines and for the reasons prescribed by the provisions of the Law on Mandatory Deadlines. The customer can send a written objection or complaint to the e-mail info@vinarija-trs.com or in writing to the address: PZ Trs with the indication Complaint.

In order to determine as quickly as possible the specific order to which the Customer has an objection, please make sure to write the order number or the invoice number in the objection. 

The customer has the right to a justified complaint and to return the goods in the following cases:

  • delivery of goods that were not ordered
  • delivery of expired goods
  • delivery of goods that have a fault or damage that did not occur during transport

If the product has a hidden defect (a defect that could not be detected during a normal inspection when picking up the item) that the Buyer finds after opening the product – the Buyer has the right to unilaterally terminate the contract and refund money, replace the product, remove the defect or reduce the price.  

Otherwise, the seller will consider the complaint valid if, after examining the product, he finds that it meets the conditions for a complaint in accordance with the Obligatory Relations Act and the Consumer Protection Act. In this case, within 15 days of receiving a valid complaint, they will replace the product or return the entire amount paid with termination of the contract. If, on the other hand, it finds that the complaint is not valid, i.e. if it rejects the complaint, it will inform the Customer about the same within 15 days from the day of receipt of the complaint.

The seller will accept the return of damaged, defective or incorrectly delivered goods at his own expense, if it is determined that the complaint is justified and that the buyer has not affected the correctness, damage or any defect of the goods.

In the event of a justified complaint, the cost of replacement with a new product is fully borne by the Seller.

Contract duration

The contract that the Buyer concludes with the Seller is a one-time contract for the purchase and sale of products at a distance, which is concluded by the delivery of the goods and the payment made by the buyer, in case it is not terminated. These Terms of Purchase (Pre-Contractual Notices) are an integral part of the contract.
